Education Records

Personal notes are defined as education records when made in the presence of others. For example, an adviser meets with a student about his grades and takes notes during their meeting. These notes are subject to FERPA because they have been made in the presence of the student and are part of the student's records.

Key Points:

  • Notes taken in the presence of another person are considered "personal notes."
  • Sharing of personal notes with another person or placing them in an area where they can be viewed by others makes them "education records."
