1. Eligibility: This Sweeptakes is open only to those who have completed the giveaway steps; on Facebook, 1) shared the 6/27/19 giveaway video on their Facebook page, 2) commented on the 6/27/19 giveaway video post, and 3) like Southern Adventist University on Facebook; or, on Instagram, 1) commented on the 6/27/19 giveaway video post, 2) tagged a friend in the comment section of the 6/27/19 giveaway video post, and 3) follow Southern Adventist University on Instagram. Participants under the age of 18 as of the date of entry must obtain their parent or legal guardian’s permission to enter. The Sweepstakes is open to legal residents of the United States (50 states and District of Columbia, but specifically excluding the territory of Puerto Rico) and to legal residents of Canada who are residing in Canada (but excluding residents of Quebec). The Sweeptakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
2. Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Southern Adventist University as final and binding as it relates to the content of this Sweeptakes.
3. Sweeptakes Period: Entries will be accepted online starting on Thursday, June 27, 2019 and ending Monday, July 1, 2019 at 11:59 p.m. EST. The winners will be announced on Tuesday, July 2, 2019.
4. How to Enter: In order to receive one entry for the Sweeptakes, the Contestant may either 1) share the 6/27/19 giveaway video on their Facebook page, 2) comment on the 6/27/19 giveaway video, and 3) like Southern Adventist University on Facebook; or, 1) comment on the 6/27/19 giveaway video, 2) tag a friend in the comments section of the 6/27/19 giveaway video post, and 3) follow Southern Adventist University on Instagram. Participant may enter once on Facebook and once on Instagram for a total of two (2) entries. Participant must like Southern Adventist University on Facebook or follow Southern Adventist University on Instagram, based upon which method of entry they have submitted, at the time when the winners are selected to be confirmed as a winner and receive one of the prizes. Any entry must fulfill all Sweeptakes requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Southern Adventist University. You must provide the information requested. You may not enter more times than indicated. If the Participant uses fraudulent methods or otherwise attempts to circumvent the rules, the Participant’s submission may be removed from eligibility at the sole discretion of Southern Adventist University.
5. Prizes: A total of five (5) Winners of the Sweeptakes will be randomly selected. Five (5) Winners will each receive a $50 Amazon.com gift card. The specifics of the prize shall be solely determined by Southern Adventist University. No cash or other prize substitution shall be permitted except at Southern Adventist University’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Southern Adventist University to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
6. Odds: The odds of winning depend on the number of eligible entries received.
7. Selection of Winners and Notification: Winners will be selected by a random drawing under the supervision of Southern Adventist University. Winners will be notified by direct message through Instagram or Facebook, and/or via email or phone number if these are known to Southern Adventist University at the time when the winner is selected. Southern Adventist University shall have no liability for a Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. If a Winner cannot be contacted, is ineligible, or fails to claim the prize within three (3) days from the time award notification was sent, the prize may be forfeited and an alternate Winner selected. Receipt by a Winner of the prize offered in this Sweeptakes is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY A WINNER (AT SOUTHERN ADVENTIST UNIVERSITY’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS A WINNER OF THE Sweeptakes, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
8. Rights Granted by You: By entering this content, You understand and agree that Southern Adventist University, anyone acting on behalf of Southern Adventist University, and Southern Adventist University licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, for a period of one year from the time a winner claims a prize, and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Sweeptakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent.
9. Terms & Conditions: Southern Adventist University reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweeptakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond Southern Adventist University’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweeptakes. In such case, Southern Adventist University may select Winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Southern Adventist University. Southern Adventist University reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweeptakes or website or violates these Terms & Conditions. Any attempt by a Participant to deliberately damage any website or undermine the legitimate operation of the Sweeptakes may be a violation of criminal and civil laws. Should such attempt be made, Southern Adventist University reserves the right to seek damages to the fullest extent permitted by law.
10. Limitation of Liability: By entering, You agree to release and hold harmless Southern Adventist University and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Sweeptakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweeptakes; (v) electronic or human error in the administration of the Promotion or the processing of entries.
11. Disputes: THIS Sweeptakes IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND TENNESSEE, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweeptakes, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweeptakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Tennessee having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Sweeptakes). Participant further waives all rights to have damages multiplied or increased.
